-webkit-margin-before: 0px; -webkit-margin-after: 0px; max-width: 100%; min-height: 1em; color: rgb(62, 62, 62); line-height: 1.75em; text-indent: 2em;">第一条     为规范拖欠农民工工资“黑名单”管理工作，加强对拖欠工资违法失信用人单位的惩戒，维护劳动者合法权益，根据《企业信息公示暂行条例》、《国务院关于建立完善守信联合激励和失信联合惩戒制度加快推进社会诚信建设的指导意见》（国发〔2016〕33号）、《国务院办公厅关于全面治理拖欠农民工工资问题的意见》（国办发〔2016〕1号），制定本办法。 <p style="list-style-type: none; -webkit-padding-start: 0px; -webkit-margin-before: 0px; -webkit-margin-after: 0px; max-width: 100%; min-height: 1em; color: rgb(62, 62, 62); line-height: 1.75em; text-indent: 2em;">第二条     本办法所称拖欠农民工工资“黑名单”（以下简称拖欠工资“黑名单”），是指违反国家工资支付法律法规规章规定，存在本办法第五条所列拖欠工资情形的用人单位及其法定代表人、其他责任人。 <p style="list-style-type: none; -webkit-padding-start: 0px; -webkit-margin-before: 0px; -webkit-margin-after: 0px; max-width: 100%; min-height: 1em; color: rgb(62, 62, 62); line-height: 1.75em; text-indent: 2em;">第三条     人力资源社会保障部负责指导监督全国拖欠工资“黑名单”管理工作。 <p style="list-style-type: none; -webkit-padding-start: 0px; -webkit-margin-before: 0px; -webkit-margin-after: 0px; max-width: 100%; min-height: 1em; color: rgb(62, 62, 62); line-height: 1.75em; text-indent: 2em;">省、自治区、直辖市人力资源社会保障行政部门负责指导监督本行政区域拖欠工资“黑名单”管理工作，每半年向人力资源社会保障部报送本行政区域的拖欠工资“黑名单”。 <p style="list-style-type: none; -webkit-padding-start: 0px; -webkit-margin-before: 0px; -webkit-margin-after: 0px; max-width: 100%; min-height: 1em; color: rgb(62, 62, 62); line-height: 1.75em; text-indent: 2em;">地方人力资源社会保障行政部门依据行政执法管辖权限，负责拖欠工资“黑名单”管理的具体实施工作。 <p style="list-style-type: none; -webkit-padding-start: 0px; -webkit-margin-before: 0px; -webkit-margin-after: 0px; max-width: 100%; min-height: 1em; color: rgb(62, 62, 62); line-height: 1.75em; text-indent: 2em;">第四条     拖欠工资“黑名单”管理实行“谁执法，谁认定，谁负责”，遵循依法依规、公平公正、客观真实的原则。 <p style="list-style-type: none; -webkit-padding-start: 0px; -webkit-margin-before: 0px; -webkit-margin-after: 0px; max-width: 100%; min-height: 1em; color: rgb(62, 62, 62); line-height: 1.75em; text-indent: 2em;">第五条     用人单位存在下列情形之一的，人力资源社会保障行政部门应当自查处违法行为并作出行政处理或处罚决定之日起20个工作日内，按照管辖权限将其列入拖欠工资“黑名单”。<p style="margin-top: 5px; list-style-type: none; -webkit-padding-start: 0px; -webkit-margin-before: 0px; -webkit-margin-after: 0px; max-width: 100%; min-height: 1em; color: rgb(62, 62, 62); text-indent: 2em; line-height: 1.5em;">（一）克扣、无故拖欠农民工工资报酬，数额达到认定拒不支付劳动报酬罪数额标准的；<p style="margin-top: 5px; list-style-type: none; -webkit-padding-start: 0px; -webkit-margin-before: 0px; -webkit-margin-after: 0px; max-width: 100%; min-height: 1em; color: rgb(62, 62, 62); text-indent: 2em; line-height: 1.5em;">（二）因拖欠农民工工资违法行为引发群体性事件、极端事件造成严重不良社会影响的。<p style="margin-top: 5px; list-style-type: none; -webkit-padding-start: 0px; -webkit-margin-before: 0px; -webkit-margin-after: 0px; max-width: 100%; min-height: 1em; color: rgb(62, 62, 62); text-indent: 2em; line-height: 1.5em;">将劳务违法分包、转包给不具备用工主体资格的组织和个人造成拖欠农民工工资且符合前款规定情形的，应将违法分包、转包单位及不具备用工主体资格的组织和个人一并列入拖欠工资“黑名单”。 <p style="list-style-type: none; -webkit-padding-start: 0px; -webkit-margin-before: 0px; -webkit-margin-after: 0px; max-width: 100%; min-height: 1em; color: rgb(62, 62, 62); line-height: 1.75em; text-indent: 2em;">第六条     人力资源社会保障行政部门将用人单位列入拖欠工资“黑名单”的，应当提前书面告知，听取其陈述和申辩意见。核准无误的，应当作出列入决定。 <p style="list-style-type: none; -webkit-padding-start: 0px; -webkit-margin-before: 0px; -webkit-margin-after: 0px; max-width: 100%; min-height: 1em; color: rgb(62, 62, 62); line-height: 1.75em; text-indent: 2em;">列入决定应当列明用人单位名称及其法定代表人、其他责任人姓名、统一社会信用代码、列入日期、列入事由、权利救济期限和途径、作出决定机关等。 <p style="list-style-type: none; -webkit-padding-start: 0px; -webkit-margin-before: 0px; -webkit-margin-after: 0px; max-width: 100%; min-height: 1em; color: rgb(62, 62, 62); line-height: 1.75em; text-indent: 2em;">第七条     人力资源社会保障行政部门应当按照有关规定，将拖欠工资“黑名单”信息通过部门门户网站、“信用中国”网站、国家企业信用信息公示系统等予以公示。 <p style="list-style-type: none; -webkit-padding-start: 0px; -webkit-margin-before: 0px; -webkit-margin-after: 0px; max-width: 100%; min-height: 1em; color: rgb(62, 62, 62); line-height: 1.75em; text-indent: 2em;">第八条     人力资源社会保障行政部门应当按照有关规定，将拖欠工资“黑名单”信息纳入当地和全国信用信息共享平台，由相关部门在各自职责范围内依法依规实施联合惩戒，在政府资金支持、政府采购、招投标、生产许可、资质审核、融资贷款、市场准入、税收优惠、评优评先等方面予以限制。 <p style="list-style-type: none; -webkit-padding-start: 0px; -webkit-margin-before: 0px; -webkit-margin-after: 0px; max-width: 100%; min-height: 1em; color: rgb(62, 62, 62); line-height: 1.75em; text-indent: 2em;">第九条     拖欠工资“黑名单”实行动态管理。 <p style="list-style-type: none; -webkit-padding-start: 0px; -webkit-margin-before: 0px; -webkit-margin-after: 0px; max-width: 100%; min-height: 1em; color: rgb(62, 62, 62); line-height: 1.75em; text-indent: 2em;">用人单位首次被列入拖欠工资“黑名单”的期限为1年，自作出列入决定之日起计算。 <p style="list-style-type: none; -webkit-padding-start: 0px; -webkit-margin-before: 0px; -webkit-margin-after: 0px; max-width: 100%; min-height: 1em; color: rgb(62, 62, 62); line-height: 1.75em; text-indent: 2em;">列入拖欠工资“黑名单”的用人单位改正违法行为且自列入之日起1年内未再发生第五条规定情形的，由作出列入决定的人力资源社会保障行政部门于期满后20个工作日内决定将其移出拖欠工资“黑名单”；用人单位未改正违法行为或者列入期间再次发生第五条规定情形的，期满不予移出并自动续期2年。 <p style="list-style-type: none; -webkit-padding-start: 0px; -webkit-margin-before: 0px; -webkit-margin-after: 0px; max-width: 100%; min-height: 1em; color: rgb(62, 62, 62); line-height: 1.75em; text-indent: 2em;">第十条     人力资源社会保障行政部门决定将用人单位移出拖欠工资“黑名单”的，应当通过部门门户网站、“信用中国”网站、国家企业信用信息公示系统等予以公示。 <p style="list-style-type: none; -webkit-padding-start: 0px; -webkit-margin-before: 0px; -webkit-margin-after: 0px; max-width: 100%; min-height: 1em; color: rgb(62, 62, 62); line-height: 1.75em; text-indent: 2em;">第十一条     用人单位被列入拖欠工资“黑名单”所依据的行政处理或处罚决定被依法变更或者撤销的，作出列入决定的人力资源社会保障行政部门应当及时更正拖欠工资“黑名单”。 <p style="list-style-type: none; -webkit-padding-start: 0px; -webkit-margin-before: 0px; -webkit-margin-after: 0px; max-width: 100%; min-height: 1em; color: rgb(62, 62, 62); line-height: 1.75em; text-indent: 2em;">第十三条     人力资源社会保障等行政部门工作人员在实施拖欠工资“黑名单”管理过程中，滥用职权、玩忽职守、徇私舞弊的，依法予以处理。 <p style="list-style-type: none;
