min-height: 1em;'> 法院审理查明，被告人潘某忠出资，伙同温某发等人经常在寻乌县城及周边乡镇各个非法赌博摊点向参赌博人员发放高利贷，在非法讨债的过程中，邀集被告人温某发等人，逐步形成了以被告人潘某忠为纠集者，以被告人温某发、曹某发、同案人杨某（在逃）为成员的恶势力犯罪团伙，实施非法拘禁、开设赌场、殴打他人等违法犯罪活动，为非作恶，欺压百姓，扰乱社会生活秩序，造成极为恶劣的社会影响。</p><p style='max-width: 100%; box-sizing: border-box; min-height: 1em;'> 法院审理认为：被告人潘某忠、温某发、曹某发明知他人开设赌场，在赌场里向参赌人员提供赌资，为他人开设赌场提供资金帮助，情节严重，其行为已经构成开设赌场罪；被告人潘某忠、温某发、余某为索取赌博债务、高利贷，采用威胁、殴打的方式，非法拘禁他人，其行为已经构成非法拘禁罪。被告人谢某添在未经住宅主人同意的情况下，非法强行闯入他人住宅，经要求退出仍拒不退出，严重影响他人正常生活，其行为已经构成非法入侵住宅罪。被告人温某发在被判处有期徒刑刑满释放后五年内再犯应当判处有期徒刑以上刑罚之罪，系累犯，依法应当从重处罚。被告人潘某忠、谢某添具有前科，酌定从重处罚。被告人潘某忠、温某发犯有数罪，依法实行数罪并罚。被告人潘某忠、温某发、曹某发、谢某添、余某归案后如实供述自己罪行，具有坦白情节，依法可以从轻处罚。</p></section></section></section></section></section></section><section powered-by="xiumi.us" style='margin-top: 10px;
