box-sizing: border-box !important;'><span style='max-width: 100%; font-size: 16px; font-family: 宋体, SimSun; box-sizing: border-box !important;'>农村土地制度改革涉及的主体、包含的利益关系十分复杂，牵一发而动全身，必须审慎稳妥推进，所以在2014年底，中办、国办印发《关于农村土地征收、集体经营性建设用地入市、宅基地改革试点工作意见》，在全国部署农村土地制度改革试点工作。由于试点突破了土地管理法和城市房地产管理法有关规定，所以2015年2月全国人大常委会通过授权决定，授权国务院在33个试点县行政区域内暂停实施土地管理法的5个条款、城市房地产管理法的1个条款。自2015年以来，33个试点地区在党中央坚强领导下大胆探索，勇于实践，农村土地制度改革取得了明显成效，也为土地管理法修改奠定了坚实的基础。</span></p><p style='max-width: 100%; box-sizing: border-box !important;'><span style='max-width: 100%; font-size: 16px; font-family: 宋体, SimSun; box-sizing: border-box !important;'>在土地征收方面这次新法做了三个方面完善。第一，首次对土地征收的公共利益进行明确界定，因为原来宪法和土地管理法都规定国家为了公共利益的需要可以征地，但是什么是公共利益？长期以来没有明确的法律规定，特别是我们土地管理法又规定，任何单位和个人使用土地必须使用国有土地，所以导致了征收成为获得土地的唯一途径。这次我们在总结试点经验的基础上，采用列举的方式，对于哪些是公共利益可以动用国家征收权作出了明确的界定。因军事外交，政府组织实施的基础设施建设、公益事业、扶贫搬迁和保障性安居工程，以及成片开发建设等六种情况确需要征地的可以依法实施征收。二是土地管理法首次明确了土地征收补偿的基本原则是保障被征地农民原有生活水平不降低，长远生计有保障。这样一个规定就改变了过去我们是以土地征收的原用途来确定土地补偿，以年产值倍数法来确定土地补偿费和安置补助费的做法，以区片综合地价取代原来的土地年产值倍数法，另外在原来的土地补偿费、安置补助费、地上附着物三项基础上又增加了农村村民住宅补偿和社会保障费，这样就从法律上为被征地农民构建了一个更加完善的保障体系。三是，完善了土地征收程序，把原来的批后公告改为了批前公告，主要是使被征地农民在整个过程中有更多参与权、监督权和话语权。</span></p><p style='max-width: 100%; box-sizing: border-box !important;'><span style='max-width: 100%; font-size: 16px; font-family: 宋体, SimSun; box-sizing: border-box !important;'>在集体经营性建设用地入市方面，这次新修改的土地管理法破除了农村集体建设用地进入市场的法律障碍。我们删除了原来土地管理法第43条，任何单位或个人需要使用土地的必须使用国有土地的规定。增加规定农村集体建设用地在符合规划、依法登记，并经三分之二以上集体经济组织成员同意的情况下，可以通过出让、出租等方式交由农村集体经济组织以外的单位或个人直接使用，同时使用者在取得农村集体建设用地之后还可以通过转让、互换、抵押的方式进行再次转让。这是土地管理法一个重大制度创新，取消了多年来集体建设用地不能直接进入市场流转的二元体制，为城乡一体化发展扫除了制度性的障碍，集体经营性建设用地入市是这次土地管理法修改的最大的亮点。</span></p><p style='max-width: 100%; box-sizing: border-box !important;'><span style='max-width: 100%; font-size: 16px; font-family: 宋体, SimSun; box-sizing: border-box !important;'>在宅基地方面在原来一户一宅的基础上增加了户有所居的规定，因为有一部分农村村民已经进城落户，对他们原来在农村的宅基地是否允许退出，这次修改允许已经进城落户的农村村民自愿有偿退出宅基地，因为农民变成市民真正实现城市化是一个漫长的过程，在整个过程中我们要有足够的耐心。如果农民不愿意退出宅基地，地方政府不能强迫其退出宅基地，必须是在自愿有偿的基础上。总体来看，这次新修改的土地管理法把农村三块地改革的成功经验全部吸收到土地管理法，在农村土地管理方面做出了多项创新性的规定。</span></p><p style='max-width: 100%; box-sizing: border-box !important;'>这次我们在土地管理法修改过程中把土地管理法中的“基本农田”全部修改为“永久基本农田”，这个修改不是简单的文字修改，而是理念的重大转变。我们用网上一个时髦的话说，这就是基本农田保护2.0版，从基本农田到永久基本农田是基本农田保护的的2.0版。这样的修改，体现了对基本农田永久保护这样一个价值的理念。2017中发4号文件提出，耕地是我国最为宝贵的资源，强调“两个决不能”，已经确定的耕地红线决不能突破，已经划定的城市周边永久基本农田决不能随便占用。十九大报告也明确提出，要完成生态红线、永久基本农田、城市开发边界三条控制线的划定工作。按照党中央、国务院的部署，我们全面推进永久基本农田划定工作，目前已经完成了2887个县级行政区域永久基本农田的划定工作，这次新修改的土地管理法总结实践中永久基本农田保护和划定的一些成功经验。在第35条明确规定永久基本农田经依法划定后任何单位和个人不得擅自占用或者改变用途，要求永久基本农田必须落实到地块，纳入数据库严格管理。同时，原来土地管理法要求各省、自治区、直辖市必须把80%以上的耕地划入永久基本农田，考虑到各省的耕地后备资源有很大的不同，所以这次新法作了一个微调，具体的划定的比例由国务院根据各省、自治区、直辖市实际情况来确定，使这部法律的规定更加符合实际。总之，保护耕地，保护永久基本农田，是我们土地管理法的核心和宗旨之一，也是在这次修订过程中坚持的一项基本原则。</span></p><p style='max-width: 100%; font-size: 16px; font-family: 宋体, SimSun; box-sizing: border-box !important;'>其实刚才这个问题魏莉华司长基本上已经都回答了，这个问题从两个方面来看。第一个方面，这次土地管理法的修改，包括集体经营性建设用地入市改革，目的就是为了改变、完善现有的建设用地土地供应的格局。原来我们只有国有的建设用地才能进入市场，以进行各项建设，现在是允许集体可以把集体的建设用地，直接由集体出让、出租用于建设，这是土地供应格局的改变。第二个方面，集体经营性建设用地入市，首先入市的土地要符合规划，规划必须是工业或者商业等经营性用途。第二个，它必须要经过依法登记。第三个，它在每年的土地利用年度计划中要作出安排。另外，即使获得了集体经营性建设用地的使用权之后的土地权利人也要按原来规划的用途来使用土地。因此从这几个方面来讲，它不会对我们的土地市场造成冲击。</span></p><p style='max-width: 100%;
