max-width: 100%; min-height: 1em; letter-spacing: 0.544px; box-sizing: border-box !important;'><span style='max-width: 100%; font-size: 15px; box-sizing: border-box !important;'>3.在合法取得的国有土地上建设且已依法取得建设工程规划许可证及相关施工批准手续并按其规定建造的房屋，认定为合法住宅房屋。</span></p><p style='text-align: justify; color: inherit; box-sizing: border-box !important;'>2．2011年9月1日至发布房屋征收范围公告前在合法取得的国有土地上建造的，符合国有土地使用权出让合同载明的规划条件的房屋，由县住建局、县自然资源局、长宁镇政府根据实际情况认定为“视为合法住宅房屋”；无法确定规划条件的，合法占地范围内三层以内实际建筑面积认定为“视为合法住宅房屋”。</span></p><p style='text-align: justify; letter-spacing: 0.544px; box-sizing: border-box !important;'><span style='max-width: 100%; font-size: 15px; box-sizing: border-box !important;'>1．私有住宅房屋，是指私人所有，证载用途为住宅的国有土地上房屋。</span></p><p style='text-align: justify; max-width: 100%; min-height: 1em; letter-spacing: 0.544px; box-sizing: border-box !important;'><span style='max-width: 100%; font-size: 15px; box-sizing: border-box !important;'>2．店面、商业、办公房屋，是指公民所有、集体所有或国家机关、国有企事业单位、民营企业所有，证载用途为店面、商业、办公的国有土地上房屋。</span></p><p style='text-align: justify; max-width: 100%; min-height: 1em; letter-spacing: 0.544px; box-sizing: border-box !important;'><span style='max-width: 100%; font-size: 15px; box-sizing: border-box !important;'>3．工业生产性房屋，是指生产性企业所有，国有工业用地上的房屋，包括厂房、办公用房、宿舍、配套用房。</span></p><p style='text-align: justify; max-width: 100%; min-height: 1em; letter-spacing: 0.544px; box-sizing: border-box !important;'><span style='max-width: 100%; font-size: 15px; box-sizing: border-box !important;'>1．被征收房屋办理了产权证的，其房屋建筑面积以产权证记载的建筑面积为准；被征收人申请重新测绘的，实施单位应当安排有资质的房产测绘机构进行测绘，并以新测绘数据为准。</span></p><p style='text-align: justify; max-width: 100%; min-height: 1em; letter-spacing: 0.544px; box-sizing: border-box !important;'><span style='max-width: 100%; font-size: 15px; box-sizing: border-box !important;'>2．被征收房屋没有办理产权证的，其房屋建筑面积以实施单位组织测绘的建筑面积为准；被征收人对测绘结果有异议的，可在收到测绘结果3日内申请重新测绘，房屋征收实施单位应当安排房产测绘机构进行复核。</span></p><p style='text-align: justify; font-size: 15px; box-sizing: border-box !important;'>被征收房屋为合法住宅房屋，且在房屋征收决定公告规定的签约期限内签约并按时搬迁弃房的，被征收人可以选择按合法住宅房屋征收货币补偿指导价格（见附件2，下同）进行补偿，也可以选择按房地产价格评估机构评估确定的被征收房屋价值进行补偿；未在规定的签约期限内签约并按时搬迁弃房的，按房地产价格评估机构评估确定的被征收房屋价值给予补偿（被征收房屋价值，包括土地使用权价值和房屋价值、房屋装修价值等，实行“房地合一”评估）。</span></section><section style='max-width: 100%; letter-spacing: 0.544px; text-indent: 2em; box-sizing: border-box !important;'><span style='max-width: 100%; font-size: 15px; box-sizing: border-box !important;'>被征收房屋为“视为合法住宅房屋”，且在房屋征收决定公告规定的签约期限内签约并按时搬迁弃房的，参照合法住宅房屋货币补偿规定执行。未在规定期限内签约并按时搬迁弃房的，但主动配合拆除的，三层（含）以下部分，按本方案合法住宅房屋征收补偿指导价格的70%给予补助；四层（含）以上部分，给予房屋重置价50%补助和220元/㎡拆除补助；未在规定时间内签约且不配合拆除的，一律以违法建筑论处并依法强制拆除，不予补偿、补助和奖励。</span></section><p style='text-align: justify; letter-spacing: 0.544px; text-indent: 2em; box-sizing: border-box !important;'><span style='max-width: 100%; font-size: 15px; box-sizing: border-box !important;'>1．被征收房屋为合法住宅房屋，按合法住宅房屋的建筑面积“征一补一”的原则进行产权调换。被征收人应当按被征收房屋与提供用于产权调换房屋面积“最接近值”的原则选择产权调换房屋。如被征收房屋与用于产权调换房屋存在面积差，安置后不足部分和安置后的剩余面积，按房屋征收决定公告之日同地段同类房屋市场价格相互结算，市场价格由依法选定的评估机构评估确定。</span></section><section style='max-width: 100%; letter-spacing: 0.544px; text-indent: 2em; box-sizing: border-box !important;'><span style='max-width: 100%; color: inherit; font-size: 15px; box-sizing: border-box !important;'>被征收房屋的价值和用于产权调换房屋的价值由依法选定的评估机构分别评估确定，评估时点均为房屋征收决定公告之日。房屋征收部门与被征收人应计算、结清被征收房屋价值与用于产权调换房屋价值的差价，对被征收房屋价值高于用于产权调换房屋价值的，由房屋征收部门向被征收人结算差价；对被征收房屋价值低于产权调换房屋价值的，由被征收人向房屋征收部门结算差价。被征收房屋价值的补偿预先抵扣产权调换房屋的购房款，并在交付产权调换房屋前据实结算、相互支付差价。涉及水、电、燃气、物业管理、住房维修基金等其余费用待交房时一并结算，由被征收人承担。</span></section><section style='max-width: 100%; letter-spacing: 0.544px; text-indent: 2em; box-sizing: border-box !important;'><span style='max-width: 100%; color: inherit; font-size: 15px; box-sizing: border-box !important;'>2．被征收房屋为“视为合法住宅房屋”，且在房屋征收决定公告规定的签约期限内签约并按时搬迁弃房的，参照合法住宅房屋产权调换方式相关规定执行；被征收人在超过签约期限未签约，或不配合拆除的，一律以违法建筑论处并强制拆除，不予补偿、补助和奖励。</span></section><section style='max-width: 100%; letter-spacing: 0.544px; text-indent: 2em; box-sizing: border-box !important;'><span style='max-width: 100%; color: inherit; font-size: 15px; box-sizing: border-box !important;'>3．被征收房屋为合法住宅房屋、“视为合法住宅房屋”的，其飘檐一律不予产权调换。</span></section><section style='max-width: 100%; letter-spacing: 0.544px; text-indent: 2em; box-sizing: border-box !important;'><span style='max-width: 100%; color: inherit; font-size: 15px; box-sizing: border-box !important;'>4．产权调换房屋。合法住宅房屋、“视为合法住宅房屋”的被征收人在房屋征收决定公告规定的签约期限签订协议并按时搬迁弃房的，给予低层住宅房屋产权调换面积奖励，被征收房屋只有一层的，按建筑面积的0.2倍奖励产权调换面积；只有两层的（房屋第二层建筑面积超过第一层建筑面积三分之一以上的计算为两层），按建筑面积0.1倍奖励产权调换面积，奖励面积免予结算。</span></section><section style='max-width: 100%; letter-spacing: 0.544px; text-indent: 2em; box-sizing: border-box !important;'><span style='max-width: 100%; color: inherit; font-size: 15px; box-sizing: border-box !important;'>5.被征收人选择房屋产权调换的，予以期房进行产权调换，产权调换房屋交房期限为自搬迁期限结束之日起不超过36个月。长宁镇被征收房屋产权调换房屋位于长宁镇中山西路。产权调换房屋为套房，主要户型有二室二厅（70㎡左右、90㎡左右，含公摊面积）、三室二厅（110㎡左右、130㎡左右，含公摊面积）。产权调换安置房的交房标准：符合国家住宅建设有关标准，进户为普通防盗门（高层为防火门），室外门窗为铝合金或塑钢，水、电到户。</span></section><section style='max-width: 100%; letter-spacing: 0.544px; text-indent: 2em; box-sizing: border-box !important;'><span style='max-width: 100%; color: inherit; font-size: 15px; box-sizing: border-box !important;'>被征收房屋所占土地为国有出让土地的，产权调换房屋建设用地为国有出让土地；被征收房屋所占土地为国有划拨土地的，产权调换房屋建设用地为国有划拨土地，五年内不得改变土地使用性质，五年后经县人民政府批准同意，且补缴土地出让金后方可改变土地使用性质，土地出让金补缴标准按县人民政府批准时间为准。</span></section><section style='max-width: 100%; letter-spacing: 0.544px; text-indent: 2em; box-sizing: border-box !important;'><span style='max-width: 100%; color: inherit; font-size: 15px; box-sizing: border-box !important;'>6.实行“谁先签约、谁先弃房，谁先选房”的原则，即签订补偿协议的顺序号加弃房的顺序号除以2进行排序选房，除以2后仍然相同的，以弃房的顺序号先后选房。</span></section><p style='text-align: justify; max-width: 100%; min-height: 1em; letter-spacing: 0.544px; box-sizing: border-box !important;'><span style='max-width: 100%; font-size: 15px; box-sizing: border-box !important;'>（四）非住宅房屋的征收补偿</span></p><p style='text-align: justify; max-width: 100%; min-height: 1em; letter-spacing: 0.544px; box-sizing: border-box !important;'><span style='max-width: 100%; font-size: 15px; box-sizing: border-box !important;'>1．非住宅房屋价值补偿</span></p><section style='max-width: 100%; letter-spacing: 0.544px; text-indent: 2em; box-sizing: border-box !important;'><span style='max-width: 100%; font-size: 15px; color: inherit; box-sizing: border-box !important;'>非住宅房屋用途包括营业用房和非营业用房。营业用房是直接用于商业活动的房屋，包括金融、娱乐、餐饮、中介等商业服务类型的房屋。非营业用房包括厂房、站场码头、仓库堆栈、果品仓储库等用房。</span></section><p style='text-align: justify; max-width: 100%; min-height: 1em; letter-spacing: 0.544px; box-sizing: border-box !important;'><br></p><section style='max-width: 100%; letter-spacing: 0.544px; text-indent: 2em; box-sizing: border-box !important;'><span style='max-width: 100%; font-size: 15px; box-sizing: border-box !important;'>（1）被征收人选择货币补偿，且被征收非住宅房屋取得了有关部门批准手续的，按房地产价格评估机构评估确定的价值给予补偿（被征收非住宅房屋价值，包括土地使用权价值和房屋价值、房屋装修价值等，实行“房地合一”评估）。</span></section><section style='max-width: 100%; letter-spacing: 0.544px; text-indent: 2em; box-sizing: border-box !important;'><span style='max-width: 100%; color: inherit; font-size: 15px; box-sizing: border-box !important;'>被征收非住宅房屋未取得批准文件且在2011年8月31日前建成，并在寻乌县规划设计院提供的2011年8月31日1:500数字化地形图上有记载的，被征收人在规定期限内签约搬迁的，按同等结构房屋重置价予以补偿；被征收房屋未取得批准文件的且在2011年8月31日后建成的非住宅房屋，被征收人在规定期限内签约搬迁的，按照同等结构房屋重置价50%予以补偿。被征收房屋未取得批准文件，且被征收人未在规定期限内签约搬迁的，按照违法建筑处理，不予补偿。上述非住宅房屋所占土地按照基准地价标准补偿（具体详见附件1）。</span></section><section style='max-width: 100%; letter-spacing: 0.544px; text-indent: 2em; box-sizing: border-box !important;'><span style='max-width: 100%; color: inherit; font-size: 15px; box-sizing: border-box !important;'>（2）取得了有关部门批准手续的非住宅房屋的被征收人选择产权调换的，政府提供不低于被征收房屋套内建筑面积的同类性质同类用途（其中非营业用房提供标准厂房）期房用于产权调换，并与被征收人计算、结清被征收房屋价值与用于产权调换房屋价值的差价，对被征收房屋价值高于用于产权调换房屋价值的，由房屋征收部门向被征收人支付结算差价，对被征收房屋价值低于用于产权调换房屋价值的，由被征收人向房屋征收部门支付结算差价。被征收房屋的价值和用于产权调换房屋的价值由依法选定的评估机构分别评估确定，评估时点均为房屋征收决定公告之日。</span></section><section style='max-width: 100%; letter-spacing: 0.544px; text-indent: 2em; box-sizing: border-box !important;'><span style='max-width: 100%; color: inherit; font-size: 15px; box-sizing: border-box !important;'>（3）被征收房屋已出租或借用的，由被征收人负责收回，进行整体搬迁交房，房屋征收部门不对承租人、借用人另行给予补偿。</span></section><p style='text-align: justify; max-width: 100%; min-height: 1em; letter-spacing: 0.544px; box-sizing: border-box !important;'><span style='max-width: 100%; font-size: 15px; box-sizing: border-box !important;'>2．因征收房屋造成停产停业损失的补偿</span></p><section style='max-width: 100%; letter-spacing: 0.544px; text-indent: 2em; box-sizing: border-box !important;'><span style='max-width: 100%; font-size: 15px; color: inherit; box-sizing: border-box !important;'>被征收房屋为非住宅房屋的，具有房屋权属证明或者经认定为合法建筑，有合法、有效的营业执照或者其他相关生产经营行政许可手续，或有其他证据证明连续经营一年以上的，因房屋被征收造成停产停业损失的，给予停产停业损失补偿。</span></section><section style='max-width: 100%; letter-spacing: 0.544px; text-indent: 2em; box-sizing: border-box !important;'><span style='max-width: 100%; color: inherit; font-size: 15px; box-sizing: border-box !important;'>根据寻乌县棚户区（城中村）改造工作领导小组办公室《关于征收非住宅房屋停产停业损失补偿有关事项的通知》（寻棚改办字〔2016〕6号）文件规定，非住宅房屋每月的停产停业损失补偿标准可按被征收非住宅房屋货币补偿金额的千分之五予以补偿；被征收人对停产停业损失补偿费有异议的，按评估机构评估确定损失金额予以补偿。</span></section><section style='max-width: 100%; letter-spacing: 0.544px; text-indent: 2em; box-sizing: border-box !important;'><span style='max-width: 100%; color: inherit; font-size: 15px; box-sizing: border-box !important;'>停产停业补偿期以月为单位计算，实行货币补偿的，补偿期为6个月；实行房屋产权调换的，补偿期自征收房屋搬迁后至产权调换房屋交付止，其中产权调换房屋为现房的，补偿期为6个月。</span></section><p style='text-align: justify; max-width: 100%; min-height: 1em; letter-spacing: 0.544px; box-sizing: border-box !important;'><span style='max-width: 100%; font-size: 15px; box-sizing: border-box !important;'>（五）房屋装修补偿</span></p><section style='max-width: 100%; letter-spacing: 0.544px; text-indent: 2em; box-sizing: border-box !important;'><span style='max-width: 100%; font-size: 15px; color: inherit; box-sizing: border-box !important;'>被征收房屋普通装饰装修（水泥地面、水电线路、外墙和内墙面水泥粉刷或刷白、木制、铝合金或塑钢门窗）不另作补偿，其相应价值已包含在被征收房屋价值补偿中，被征收房屋精装饰装修的，可按本方案（见附件5）所列项目和标准给予补偿；被征收人对补偿项目或标准有异议的，可以委托房地产价格评估机构通过评估确定补偿金额。</span><br style='max-width: 100%; font-size: 15px; color: inherit; box-sizing: border-box !important;'>1．主房以外的厕所、洗澡间、杂物间、栏舍等附属房屋、构筑物、附属设施，按本方案规定标准给予货币补偿（详见附件3、4、5）。</span></section><section style='max-width: 100%; letter-spacing: 0.544px; text-indent: 2em; box-sizing: border-box !important;'><span style='max-width: 100%; color: inherit; font-size: 15px; box-sizing: border-box !important;'>2．原属合法住宅用房，被征收人改变房屋用途用作经营性用房的，仍按住宅房屋给予补偿。该房屋办理了相关证照（营业执照、经营许可、税务登记证明等）、在房屋征收决定公告发布前已连续经营一年以上的，对实际用于经营的部分（房屋第一层，进深不超过6米），增计该部分货币补偿指导价的30%进行补偿(包括商品及营业用具自行处理、搬运等因搬迁需要补偿的一切费用)。</span></section><p style='text-align: justify; max-width: 100%; min-height: 1em; letter-spacing: 0.544px; box-sizing: border-box !important;'><span style='max-width: 100%; font-size: 15px; box-sizing: border-box !important;'>（七）因征收房屋造成的搬迁和临时安置补偿</span></p><section style='max-width: 100%; letter-spacing: 0.544px; text-indent: 2em; box-sizing: border-box !important;'><span style='max-width: 100%; font-size: 15px; color: inherit; box-sizing: border-box !important;'>1．因征收房屋造成的搬迁补偿：被征收房屋为住宅房屋的，按合法主房面积5元/㎡的标准给予被征收人搬迁补偿，搬迁补偿不足1000元/户的补足至1000元/户；</span></section><section style='max-width: 100%; letter-spacing: 0.544px; text-indent: 2em; box-sizing: border-box !important;'><span style='max-width: 100%; color: inherit; font-size: 15px; box-sizing: border-box !important;'>被征收房屋为店面、商业、办公房屋的，按合法住宅房屋面积20元/㎡标准给予搬迁补偿，搬迁补偿不足1000元的补足至1000元/户；</span></section><section style='max-width: 100%; letter-spacing: 0.544px; text-indent: 2em; box-sizing: border-box !important;'><span style='max-width: 100%; color: inherit; font-size: 15px; box-sizing: border-box !important;'>（七）党员干部和国家公职人员要带头模范执行土地房屋征收政策，全力支持、配合、服务征收工作，推动棚户区改造项目顺利实施。土地房屋征收涉及的党员干部和国家公职人员所在单位的党政主要负责同志，要负责做好他们的思想工作，教育他们自觉执行土地房屋征收有关规定。纪检监察机关和组织人事部门要充分发挥职能作用，加强对各级各部门及党员干部和国家公职人员在征收工作中执行有关法规、政策、纪律情况的监督检查。对在棚户区改造土地房屋征收中违反有关规定，损害国家、集体和群众利益，造成不良影响的，视情节轻重给予组织处理和纪律处分。</span></section><section style='max-width: 100%;
