255);'="">（一）村级审查。符合宅基地申请条件的建房户，以户为单位向所在村民小组或村委会提出宅基地和建房（规划许可）书面申请。村民小组或村委会收到申请后，应在五个工作日内完成审查，并将申请理由、拟用地位置和面积、拟建房层高和面积等情况在申请人所在小组及村务公开栏公示七天。公示无异议或异议不成立的，村委会应在《寻乌县农村宅基地和建房（规划许可）申请表》上签署意见，并将申请资料、《会议记录》、公示图片、申请表等材料报送乡（镇）人民政府审查。<p 255);'="">（三）乡（镇）审批和部门备案。乡（镇）人民政府在完成各部门联审结果后，五个工作日内召开乡（镇）长办公会进行审批，印发《农村宅基地批准书》及《乡村建设规划许可证》，加盖乡（镇）人民政府公章。在完成审批后，应在五个工作日内将建房审批结果报县农业农村局和自然资源局进行备案，涉及相关部门的，应同步报送相关部门备案。<p style='margin-top: 255);'="">（四）放线施工。乡（镇）人民政府完成审批后，应在建房户提出放线申请后五个工作日内，按批准位置和面积，组织好现场实地放线定界工作，同时下发《开工通知书》，通知建房户开工建设。建房户应严格按照批准位置和面积开工建设。《乡村规划许可证》及《农村宅基地批准书》有效期三年，逾期未建设的，证书自行失效。<p style='margin-top: 1em;margin-bottom: 255);'="">第一条为贯彻落实党和国家机构改革精神，落实新修订的土地管理法和宅基地管理改革有关要求，深化“放管服”改革，进一步依法规范我县农村居民建房审批管理，保障农民住有所居，助推乡村振兴和美丽宜居乡村建设。根据《中华人民共和国土地管理法》《中华人民共和国城乡规划法》等法律法规及《农业农村部自然资源部关于规范农村宅基地审批管理的通知》（农经发〔2019〕6号）、《江西省人民政府办公厅关于切实加强农村住房建设管理的通知》（赣府厅字〔2014〕55号）、《江西省人民政府办公厅关于进一步加强农村建房规划管理的意见》（赣府厅发〔2016〕63号）、《赣州市农村村民住房建设管理办法》（赣州市人民政府令第七十四号）等政策规定，结合我县实际，制定本办法。<p 255);'="">第二条在县城规划区外，农村集体土地上的农村居民新建、改建、扩建住房（以下统称农村建房）审批管理，适用本办法。<p style='margin-top: 1em;margin-bottom: 1em;font-family: ' open="" sans',="" arial,="" 'hiragino="" sans="" gb',="" stheiti,="" rgb(255,="" 255,="" 255);'="">第三条坚持“政府主导、部门指导、乡镇主责、村级主体”的农村建房审批管理机制。坚持“规划先行、一户一宅、住有所居、先批后建、风貌统一、节约用地、集约发展”的农村建房管理原则。<p style='margin-top: 1em;margin-bottom: 1em;font-family: ' open="" sans',="" 255);'="">（一）县农业农村局负责农村宅基地改革和管理工作。具体负责农村宅基地分配、使用、流转、违法用地查处等管理工作；完善宅基地用地标准，指导宅基地合理布局、闲置宅基地和闲置农房利用，组织开展农村宅基地现状和需求情况统计调查；负责组织农村建房新增建设用地需求汇总，并通报县自然资源局；参与编制国土空间规划和村庄规划；负责县农村建房领导小组办公室日常工作，组织开展业务指导、培训。<p 255);'="">（二）县自然资源局负责国土空间规划、土地利用计划和建房规划许可等工作。具体负责审查建房用地是否符合国土空间规划、用途管制要求，依法办理农用地转用新增建设用地审批和规划许可等相关手续，指导乡（镇）开展规划执法工作，对违反规划建设行为进行监督监管。<p style='margin-top: 1em;margin-bottom: 1em;font-family: ' open="" 255);'="">（九）各乡（镇）人民政府按照属地管理的原则，负责编制好乡（镇）总体规划、控制性详细规划和村庄规划，负责宅基地审批和受委托的规划许可工作。具体负责辖区内农村建房政策宣传、建房审批、台账管理、施工安全、巡查监管、规划管控、风貌管控，违法用地和违法建设行为的制止、上报，配合主管部门对农村建房“两违”行为查处等工作。<p style='margin-top: 255);'="">（十）申请在道路交通沿线及河湖沿岸两侧控制地段内，以及旅游景区、传统村落、文物保护单位周边、各类自然保护地等重点区域内建房，未经主管部门审查备案建设的；<p style='margin-top: 1em;margin-bottom: 1em;font-family: ' open="" sans',="" arial,="" 'hiragino="" sans="" 'hiragino="" sans="" gb',="" stheiti,="" 'wenquanyi="" micro="" hei',="" 'microsoft="" yahei="" ui',="" 微软雅黑,="" simsun,="" sans-serif;font-size:="" 16px;white-space:="" normal;line-height:="" 1.33;text-indent:="" 2em;background-color:="" rgb(255,="" 255,="" 255);'="">（十五）宅基地使用存在争议，未处置到位的；<p style='margin-top: 1em;margin-bottom: 1em;font-family: ' open="" sans',="" arial,="" 'hiragino="" 255);'="">（三）需要拆除旧房申请重新建房，但拒绝拆除旧房的；<p style='margin-top: 1em;margin-bottom: 1em;font-family: ' open="" sans',="" arial,="" 'hiragino="" sans="" gb',="" stheiti,="" 'wenquanyi="" micro="" hei',="" 255);'="">第三章规划及建筑风貌要求<p style='margin-top: 1em;margin-bottom: 1em;font-family: ' open="" sans',="" arial,="" 'hiragino="" sans="" gb',="" stheiti,="" 'wenquanyi="" micro="" hei',="" 'microsoft="" 255);'="">（一）严格执行“一户一宅”政策，确保户有所居，严格执行房屋地块位置、占（用）地面积、建筑面积、建筑层数、建筑高度、建筑间距、建筑退距、地面标高、建筑风貌设计等规定要求；<p style='margin-top: 1em;margin-bottom: 1em;font-family: ' open="" sans',="" arial,="" 'hiragino="" sans="" gb',="" stheiti,="" 'wenquanyi="" micro="" hei',="" 'microsoft="" yahei="" ui',="" 微软雅黑,="" simsun,="" sans-serif;font-size:="" 16px;white-space:="" normal;line-height:="" 1.33;text-indent:="" 2em;background-color:="" rgb(255,="" 255,="" 255);'="">（二）严格控制乡（镇）规划区外各行政村农民建房宅基地和规划建设标准。每户农村建房宅基地总用地面积不得超过120平方米，建筑总占地面积不得超过90平方米，建筑面积不得超过270平方米，建筑层数不得超过3层，建筑总层高不得超过12.4米（含坡屋顶），且应与周边房屋批准高度保持协调。<p 255);'="">（一）农村建房建筑设计应符合村庄规划确定的建筑风貌，建房户可自行聘请有资质的单位进行建筑设计，也可以在《寻乌县农村建房图集》中选定。各乡（镇）人民政府在审批农村建房时，既要审批宅基地及规划，又要审批建筑设计方案，要积极引导建房户按照《赣南乡村风貌建设改造导则》和《赣南乡村建筑风貌营造指引》要求进行建筑风貌设计及建设。建房户在建设时，必须按照审批的建筑设计方案进行建设。<p style='margin-top: 1em;margin-bottom: 1em;font-family: ' open="" sans',="" arial,="" 'hiragino="" sans="" gb',="" stheiti,="" 'wenquanyi="" micro="" hei',="" 'microsoft="" yahei="" ui',="" 微软雅黑,="" 255);'="">（二）建筑风貌应体现“一村一貌”，原则上以村为单位统一规划设计，体现客家民居特色，风格、色彩、用材要相一致。各乡（镇）人民政府可依据村庄规划，统一选定并审批农村建房建筑风貌。其中道路交通沿线、示范乡（镇）、特色小镇、乡村振兴示范点（线）、传统村落、历史文化名村范围内的新建房屋，必须严格按政府统一规划的建筑风貌建设。<p style='margin-top: 255);'="">（三）探索建立村民理事会建筑风貌管控制度。乡、村两级是建筑风貌管控的责任主体，在符合村民组织法和村规民约的前提下，鼓励村民理事会参与建筑风貌管控，鼓励建筑风貌由村民理事会组织专业施工队伍按批准的统一标准建设，建设资金由理事会成员（建房户）自行负责，确保按审批要求统一建筑风貌。<p style='margin-top: 1em;margin-bottom: 16px;white-space:="" normal;line-height:="" 1.33;text-indent:="" 2em;background-color:="" rgb(255,="" 255,="" 255);'="">第十三条规范审批程序，进一步提高审批工作效率。各乡（镇）、各部门要严格按照“统一规划、联审快批、联放联验、批管联动、落实责任”的原则进行审批。具体程序如下：<p style='margin-top: 1em;margin-bottom: 1em;font-family: ' open="" sans',="" arial,="" 'hiragino="" sans="" gb',="" stheiti,="" 'wenquanyi="" micro="" hei',="" 'microsoft="" yahei="" ui',="" 微软雅黑,="" 255);'="">（一）村级审查。符合宅基地申请条件的建房户，以户为单位向所在村民小组或村委会提出宅基地和建房（规划许可）书面申请，填写《寻乌县农村宅基地和建房（规划许可）申请表》、《寻乌县农村宅基地使用承诺书》。<p style='margin-top: 1em;margin-bottom: 1em;font-family: ' open="" sans',="" arial,="" 'hiragino="" sans="" gb',="" stheiti,="" 'wenquanyi="" micro="" hei',="" 'microsoft="" yahei="" ui',="" 微软雅黑,="" simsun,="" sans-serif;font-size:="" 16px;white-space:="" normal;line-height:="" 1.33;text-indent:="" 2em;background-color:="" rgb(255,="" 255,="" 255);'="">村民小组或村委会收到申请后，应在五个工作日内完成审查，重点审查是否符合“一户一宅”、是否为本村村民、提交的申请材料是否真实有效，现场查看拟用地建房是否违反禁止、限制条件，是否符合村庄规划、是否征求了用地建房相邻权利人意见等，同时提交村民代表会议讨论并形成《会议记录》，并将申请理由、拟用地位置和面积、拟建房层高和面积等情况在申请人所在小组及村务公开栏公示七天。公示无异议或异议不成立的，村委会应在《寻乌县农村宅基地和建房（规划许可）申请表》上签署意见，并将申请资料、《会议记录》、公示图片、申请表等材料报送乡（镇）人民政府审查。<p style='margin-top: 1em;margin-bottom: 1em;font-family: ' open="" sans',="" arial,="" 'hiragino="" sans="" gb',="" stheiti,="" 'wenquanyi="" micro="" hei',="" 'microsoft="" yahei="" ui',="" 微软雅黑,="" simsun,="" sans-serif;font-size:="" 16px;white-space:="" normal;line-height:="" 1.33;text-indent:="" 2em;background-color:="" rgb(255,="" 255,="" 255);'="">（二）乡（镇）、部门联审。乡（镇）人民政府要在便民服务中心设立“一个窗口”，统一对外受理，积极组织各职能部门做好农村建房联审联批工作。在收到村委会提交的建房户申请后，乡（镇）人民政府应在十个工作日内（不含新增建设用地、林地上报审批时间）组织县农业农村、县自然资源等部门完成联审工作，重点审查申请人是否符合条件、拟用地是否符合规划和地类等，并在《寻乌县农村宅基地和建房（规划许可）审批表》上签署审查意见。<p style='margin-top: 1em;margin-bottom: 1em;font-family: ' open="" sans',="" arial,="" 'hiragino="" sans="" gb',="" stheiti,="" 'wenquanyi="" micro="" hei',="" 'microsoft="" yahei="" ui',="" 微软雅黑,="" simsun,="" sans-serif;font-size:="" 16px;white-space:="" normal;line-height:="" 1.33;text-indent:="" 2em;background-color:="" rgb(255,="" 255,="" 255);'="">审查过程中，县农业农村部门负责审查申请人是否符合申请条件、拟用地是否符合宅基地合理布局要求和面积标准、宅基地和建房（规划许可）申请是否经过村组审核公示等，并综合各有关部门意见提出审批建议；县自然资源部门负责审查建房用地地类、是否符合国土空间规划、用途管制要求，其中：涉及占用农用地和未利用地等新增建设用地的，由乡（镇）人民政府汇总上报至县自然资源部门后，由县自然资源部门分批次组织上报市政府批准农用地和未利用地转用，再委托乡（镇）人民政府核发《乡村建设规划许可证》；涉及占用林地、湿地的，由乡（镇）人民政府汇总上报县林业主管部门审核，经依法批准后核发《使用林地审核同意书》。涉及县交通运输、公路、水利、文广新旅等部门的，要同步组织审查，并在审批表中签署审核意见。<p style='margin-top: 1em;margin-bottom: 1em;font-family: ' open="" sans',="" arial,="" 'hiragino="" sans="" gb',="" stheiti,="" 'wenquanyi="" micro="" hei',="" 'microsoft="" yahei="" ui',="" 微软雅黑,="" 255);'="">（三）乡（镇）审批和部门备案。乡（镇）人民政府在完成各部门联审结果后，五个工作日内召开乡（镇）长办公会进行审批，印发《农村宅基地批准书》及《乡村建设规划许可证》，加盖乡（镇）人民政府公章。乡（镇）人民政府要建立农村建房审批管理台账，审批资料要规范管理并归档留存。在完成审批后，应在五个工作日内将建房审批结果报县农业农村局和自然资源局进行备案，涉及县交通运输、公路、林业、水利、文广新旅等部门的，应同步报送相关部门备案。<p style='margin-top: 1em;margin-bottom: 1em;font-family: ' open="" sans',="" arial,="" 'hiragino="" sans="" gb',="" stheiti,="" 'wenquanyi="" micro="" hei',="" 'microsoft="" yahei="" ui',="" 微软雅黑,="" 255);'="">（四）放线施工。乡（镇）人民政府完成审批后，应在建房户提出放线申请后五个工作日内，按批准位置和面积，组织好现场实地放线定界工作，同时下发《开工通知书》，通知建房户开工建设。建房户应严格按照批准位置和面积开工建设。《乡村规划许可证》及《农村宅基地批准书》有效期三年，逾期未建设的，证书自行失效。<p style='margin-top: 1em;margin-bottom: 1em;font-family: ' open="" sans',="" arial,="" 'hiragino="" sans="" gb',="" stheiti,="" 'wenquanyi="" micro="" hei',="" 'microsoft="" yahei="" ui',="" 微软雅黑,="" simsun,="" sans-serif;font-size:="" 255);'="">（五）批后监管。乡（镇）人民政府应当严格监督农民按照审批要求进行建设，坚决落实农村建房乡（镇）人民政府、村委会、建房户“三到场一公示”批后巡查监管要求，按巡查情况填写《寻乌县农村建房批后监管“三到场”巡查表》。<p style='margin-top: 1em;margin-bottom: 1em;font-family: ' open="" sans',="" arial,="" 'hiragino="" sans="" gb',="" stheiti,="" 'wenquanyi="" micro="" hei',="" 'microsoft="" yahei="" ui',="" 微软雅黑,="" simsun,="" sans-serif;font-size:="" 16px;white-space:="" normal;line-height:="" 1.33;text-indent:="" 2em;background-color:="" rgb(255,="" 255,="" 255);'="">1. 基础施工。由乡（镇）人民政府组织三方人员到现场，主要查看地基范围与审批位置及面积是否一致，是否存在“批少建多”“批东建西”等情况，督促建房户必须严格按照放线位置、面积等批准内容进行施工。<p style='margin-top: 1em;margin-bottom: 1em;font-family: ' open="" sans',="" arial,="" 'hiragino="" sans="" gb',="" stheiti,="" 'wenquanyi="" micro="" hei',="" 'microsoft="" yahei="" ui',="" 微软雅黑,="" simsun,="" sans-serif;font-size:="" 16px;white-space:="" normal;line-height:="" 1.33;text-indent:="" 2em;background-color:="" rgb(255,="" 255,="" 255);'="">2. 建中巡查。建房户在建房过程中，乡（镇）人民政府必须组织三方人员现场查看，主要查看是否持证施工、安全施工，是否超高超面积建房等。<p style='margin-top: 1em;margin-bottom: 1em;font-family: ' open="" sans',="" arial,="" 'hiragino="" sans="" gb',="" stheiti,="" 'wenquanyi="" micro="" hei',="" 'microsoft="" yahei="" ui',="" 微软雅黑,="" simsun,="" sans-serif;font-size:="" 16px;white-space:="" normal;line-height:="" 1.33;text-indent:="" 2em;background-color:="" rgb(255,="" 255,="" 255);'="">3．建筑立面施工。房屋外墙、屋顶施工时，乡（镇）人民政府应再次组织三方人员到现场进行查看，主要查看房屋是否符合农村建房标准，是否按图施工，外墙和屋顶是否进行风貌建设等，对不符合上述要求的建房户，责令其限期改正，拒不改正的，不予验收，依法撤销其批准文书，并按“两违”建筑处理，造成的一切损失由建房户自行负责。<p style='margin-top: 1em;margin-bottom: 1em;font-family: ' open="" sans',="" arial,="" 'hiragino="" sans="" gb',="" stheiti,="" 'wenquanyi="" micro="" hei',="" 'microsoft="" yahei="" ui',="" 微软雅黑,="" simsun,="" sans-serif;font-size:="" 16px;white-space:="" normal;line-height:="" 1.33;text-indent:="" 2em;background-color:="" rgb(255,="" 255,="" 255);'="">4. 公示制度。经乡（镇）人民政府审批后，由乡（镇）人民政府统一制作《寻乌县农村建房监督公示牌》，在一层房屋醒目位置张贴，接受群众监督。监督牌包含建房户姓名、联系方式、审批建筑占地面积、审批建筑面积、审批房屋层数、村级监督人、乡（镇）审核人等。<p style='margin-top: 1em;margin-bottom: 1em;font-family: ' open="" sans',="" arial,="" 'hiragino="" sans="" gb',="" stheiti,="" 'wenquanyi="" micro="" hei',="" 'microsoft="" yahei="" ui',="" 微软雅黑,="" simsun,="" sans-serif;font-size:="" 16px;white-space:="" normal;line-height:="" 1.33;text-indent:="" 2em;background-color:="" rgb(255,="" 255,="" 255);'="">（六）联合验收。房屋竣工后，建房户应及时向乡（镇）人民政府提出竣工验收的申请，并提交《竣工验收申请书》（详见附件5），乡（镇）人民政府应在五个工作日内组织村委会、农业农村、自然资源等相关部门进行现场验收，实地检查是否按照批准面积、四至要求，是否按照规划、建筑风貌等要求建设，依法完成验收手续。验收合格的，下发《寻乌县农村宅基地和建房（规划许可）验收意见书》。<p style='margin-top: 1em;margin-bottom: 1em;font-family: ' open="" sans',="" arial,="" 'hiragino="" sans="" gb',="" stheiti,="" 'wenquanyi="" micro="" hei',="" 'microsoft="" yahei="" ui',="" 微软雅黑,="" simsun,="" sans-serif;font-size:="" 16px;white-space:="" normal;line-height:="" 1.33;text-indent:="" 2em;background-color:="" rgb(255,="" 255,="" 255);'="">（七）办理产权登记。建房户房屋竣工验收合格后，应及时向不动产登记部门申请办理不动产登记，并提供办理不动产权证书相关资料，符合办证条件且资料齐全的，不动产登记部门应在五个工作日内办理《不动产权证书》。<p style='margin-top: 1em;margin-bottom: 1em;font-family: ' open="" sans',="" arial,="" 2em;background-color:="" rgb(255,="" 255,="" 255);'="">第十四条农村村民未经批准或者采取欺骗手段骗取批准，非法占用土地建住宅的，由县农业农村局责令退还非法占用的土地，限期拆除在非法占用的土地上新建的房屋。<p style='margin-top: 1em;margin-bottom: 1em;font-family: ' open="" sans',="" arial,="" 'hiragino="" sans="" gb',="" stheiti,="" 'wenquanyi="" micro="" hei',="" 'microsoft="" yahei="" ui',="" 微软雅黑,="" simsun,="" sans-serif;font-size:="" 16px;white-space:="" normal;line-height:="" 1.33;text-indent:="" 2em;background-color:="" rgb(255,="" 255,="" 255);'="">责令限期拆除在非法占用的土地上新建的房屋的，建房户必须立即停止施工，自行拆除；对继续施工的，乡（镇）人民政府有权制止，县农业农村局有权依法查处。建房户对责令限期拆除的行政处罚决定不服的，可以在接到责令限期拆除决定之日起十五日内，向人民法院起诉；期满不起诉又不自行拆除的，由作出处罚决定的机关依法申请人民法院强制执行，费用由违法者承担。<p style='margin-top: 1em;margin-bottom: 1em;font-family: ' open="" sans',="" arial,="" 'hiragino="" sans="" gb',="" stheiti,="" 'wenquanyi="" micro="" hei',="" 'microsoft="" yahei="" ui',="" 微软雅黑,="" simsun,="" 255);'="">第十五条农村村民在建房过程中不按批准的房屋地块位置、占（用）地面积、建筑面积、建筑层数、建筑高度、建筑间距、建筑退距、地面标高及建筑风貌等内容及建筑设计图纸施工的，由乡（镇）人民政府责令其停止建设、限期改正，拒不改正以及新房建成后不拆旧房的，不予竣工验收，不予办理《不动产权证》，同时按“两违”建筑处理，并依法撤销其批准文书，一切损失由建房户自行承担。<p style='margin-top: 1em;margin-bottom: 1em;font-family: ' open="" sans',="" arial,="" 'hiragino="" sans="" gb',="" stheiti,="" 'wenquanyi="" micro="" hei',="" 'microsoft="" yahei="" ui',="" 微软雅黑,="" 255);'="">第十六条按照“谁审批，谁负责，谁监管”的原则，乡（镇）人民政府对农村建房审批负主体责任和批后巡查监管责任，乡（镇）人民政府应设立农村建房违法行为举报信箱，公布举报电话，按照批后监管“三到场一公示”要求对建设过程进行巡查监管，对不按规划及宅基地用地要求进行建设的，应及时予以纠正和处置。因审批、监管不到位形成“两违”建筑的，严格按照《寻乌县“两违”整治工作问责办法》予以问责。村集体组织应监督建房户按批准的规划和用地要求进行建设，加强批前审查、批后监管，指导理事会运作好建筑风貌管控制度。<p style='margin-top: 1em;margin-bottom: 1em;font-family: ' open="" sans',="" arial,="" 'hiragino="" sans="" gb',="" stheiti,="" 'wenquanyi="" micro="" hei',="" 'microsoft="" yahei="" ui',="" 微软雅黑,="" simsun,="" sans-serif;font-size:="" 16px;white-space:="" normal;line-height:="" 1.33;text-indent:="" 2em;background-color:="" rgb(255,="" 255,="" 255);'="">乡（镇）、相关职能部门国家工作人员及村“两委”工作人员对建房申请、审查、审核、审批、施工放线、监督管理、竣工验收等全过程进行监管。涉及玩忽职守、滥用职权、徇私舞弊的，由县纪委（监委）依法依纪处理；涉及犯罪的，移交司法机关依法追究刑事责任。<p style='margin-top: 1em;margin-bottom: 1em;font-family: ' open="" 255);'="">第十八条县人民政府建立完善农村建房管理目标考核责任制，将农村建房管理工作纳入乡（镇）人民政府年度目标考核。县农业农村局、县自然资源局等部门应加强业务指导和服务工作，加强审查备案及批后监管制度建设，县农村建房工作领导小组办公室应于每年年底组织对乡（镇）本年度审批的农村建房情况进行全覆盖式实地核查。<p style='margin-top: 1em;margin-bottom: 1em;font-family: ' open="" sans',="" arial,="" 'hiragino="" sans="" gb',="" stheiti,="" 'wenquanyi="" micro="" hei',="" 'microsoft="" yahei="" ui',="" 微软雅黑,="" simsun,="" sans-serif;font-size:=""
