display: inline-block; float: left; line-height: 1.6em; margin-right: 5px; margin-left: 5px; max-width: 100%; padding-right: 10px; padding-left: 2em; vertical-align: top; font-family: inherit;'>征地补偿安置</section></section></section> 　　（一）江西寻乌至广东龙川高速公路（江西境内段）新建工程项目征收范围包括南桥镇古坑村、珠村村、长江村、南龙村、车头村；留车镇飞龙村、余田村、水背村、庄干村、大同村；菖蒲乡黄田村、铜锣村、虎石村、菖蒲村等3个乡（镇）14个村的部分集体土地及地上房屋、附属物、构筑物等，具体以征收土地告知书确定的征收红线图为准；主要地类为林地、果园、其他农用地、荒山荒坡；土地面积约为3185.373亩；青苗种类主要为水稻、蔬菜、果树、林木等。 　　（二）征地补偿费包括土地补偿费、安置补助费、青苗补偿费等费用，其中土地补偿费直接支付给相应的被征地集体经济组织，经村民代表会议决议可以直接支付给被征地农民，主要用于缴纳被征地农民的养老保险、发展集体经济、解决被征地农民生产生活出路；安置补助费直接支付给被安置的人员即被征地农民，青苗补偿费直接支付给青苗所有者。 　　（三）各地类的征地补偿标准和青苗补偿费等，根据《江西省人民政府关于公布全省征地区片综合地价的通知》（赣府字〔2020〕9号）、《寻乌县人民政府关于公布实施全县征地区片综合地价的通知》（寻府字〔2020〕37号）规定，分别按照相应区片相应地类征地补偿标准给予补偿（详见附件1、2）。 　　（四）被征地农民的社会养老保险按照《江西省人民政府办公厅转发省人社厅等部门关于进一步完善被征地农民基本养老保险政策意见的通知》（赣府厅发〔2014〕12号）、《关于加快推进我市被征地农民参加基本养老保险工作的通知》（赣市人社字〔2017〕293号）、《寻乌县人民政府关于印发寻乌县被征地农民参加基本养老保险实施办法的通知》（寻府发〔2016〕4号）等文件执行。 <section data-tools="135编辑器" data-id="29514"><section style='margin-top: 0.5em; display: inline-block; float: left; line-height: 1.6em; margin-right: 5px; margin-left: 5px; max-width: 100%; padding-right: 10px; padding-left: 2em; vertical-align: top; font-size: 16px; font-family: inherit;'>房屋性质认定、建筑面积、集体组织成员的认定</section></section></section> 　　五、房屋性质认定、建筑面积、集体组织成员的认定 　　（一）房屋性质认定 　　1．农村居民住宅房屋的合法性凭批准用地建房手续、宅基地使用权证、集体土地建设用地使用证、房屋所有权证等有效证件认定。 　　2．依法享有“一户一宅”合法权益但权证不全的房屋，且不存在认定为违法建筑情形的房屋，自愿申报并按时签约、搬迁的，可参照合法房屋予以补偿，不申报、不按时签约或不按时搬迁的，按违法建筑处理。 　　3．有下列情形之一的，认定为违法建筑： 　　（1）乡（镇）人民政府或原县国土局、规划建设局等有关部门在发布征收土地告知书前已经认定为违法建筑或采取措施部分拆除，但未完全拆除的房屋； 　　（2）非本集体经济组织成员非法买卖集体土地或者非法占用农村集体土地建设的房屋； 　　（3）在本项目征收土地告知书发布后，抢建、搭建、加层的主房屋、附属房。 　　（4）法律法规规定的其他情形。 　　（二）建筑面积认定 　　1．被拆迁房屋办理了产权证的，其房屋建筑面积以产权证记载的建筑面积为准，被征收人提出申请要求重新测量的，以新测量数据为准。 　　2．被拆迁房屋没有办理产权证的，其房屋建筑面积以实施单位组织测绘的建筑面积为准；被征收人对测绘结果有异议的，可在收到测绘结果3日内申请重新测绘，实施单位应当安排有资质的房产测绘机构进行复核。 　　3．被拆迁房屋建筑面积的测绘和计算，按《赣州市房屋建筑面积计算规则（试行）》（2014年修订）规定执行，但被拆迁房屋飘檐面积按水平投影面积折半计算。 　　房屋楼面（或地面）至墙体水平顶端2.2米以上（含2.2米）按一层计算面积；2.0-2.2米（不含2.2米）按80%折算面积；1.8-2.0米（不含2米）按60%折算面积；1.6-1.8米（不含1.8米）按50%折算面积；1.6米以下（不含1.6米）不计算面积。 　　4．住房、客厅、厨房及与其一体的房屋面积作为主房，计入合法建筑面积；独立的厕所、洗澡间、杂物间、门楼，牛栏、猪栏、果园看管房等作为附属房。 　　（三）集体经济组织成员认定 　　1．下列人员可以认定为被征地集体经济组织成员： 　　（1）户籍在被征地集体经济组织内，依法取得宅基地使用权、土地承包权、参与分配集体经济组织所得收益或承担集体经济组织义务的村民； 　　（2）户籍在被征地集体经济组织内的在校学生，或就读大中专院校前户籍在被征地集体经济组织内的在校学生，或大中专院校毕业后户籍直接迁回被征地集体经济组织内的村民； 　　（3）入伍前户籍在被征地集体经济组织内的现役士兵和按国家政策不予安置的士官； 　　（4）服刑前户籍在被征地集体经济组织内的正在服刑人员； 　　（5）法律、法规、规章和国家政策规定的可以认定为被征地集体经济组织成员的其他情形。 　　2．共同生活居住在同一住址的被征收人家庭人口，立为一户。 　　3．符合下列条件的，可以分户： 　　（1）父母及多个儿子登记为一户，现儿子已结婚的； 　　（2）两兄弟以上（含两兄弟）均结婚且登记为一户的； 　　（3）两兄弟以上（含两兄弟）有一方未婚且登记为一户的，未婚一方达到法定结婚年龄的； 　　（4）纯女户家庭父母及多个女儿登记为同户，且女儿达到法定婚龄的，只允许分出一户。 　　4．具有下列情形之一的，必须合户： 　　（1）夫妻之间必须合户； 　　（2）未到法定婚龄子女与其父母之间必须合户； 　　（3）征收土地告知书发布后离婚的，仍按一户计算； 　　（4）无民事行为能力人和限制民事行为能力人有监护人的，应与监护人合为一户。 <section data-tools="135编辑器" data-id="29514"><section style='margin-top: 0.5em; display: inline-block; float: left; line-height: 1.6em; margin-right: 5px; margin-left: 5px; max-width: 100%; padding-right: 10px; padding-left: 2em; vertical-align: top; font-family: inherit;'>房屋拆迁安置</section></section></section> 　　拆迁集体土地上合法住宅房屋，实行宅基地安置、房屋安置或货币安置，被征收人只能选择其中一种安置方式，且选择宅基地安置必须符合相应条件。 　　（一）宅基地安置 　　1．安置原则 　　（1）“一户一宅”原则； 　　（2）统一规划、统一户型、统一立面； 　　（3）先签约先安置； 　　（4）禁止宅基地买卖、转让。 　　2．选择宅基地安置，必须符合下列条件： 　　（1）被征收人除被拆迁房屋外，在被征地集体经济组织内没有其他合法住宅房屋； 　　（2）被征收人为被征地集体经济组织成员； 　　（3）被征收人在征收范围内有合法住宅房屋被征收。 　　3．安置地点、面积、建筑要求 　　（1）南桥镇、留车镇、菖蒲乡人民政府在符合国土空间规划（含乡镇土地利用总体规划、乡镇建设总体规划和村庄规划等）的前提下，根据实际情况采取集中安置或合理选址、分散安置。 　　（2）安置地点选址规划由南桥镇、留车镇、菖蒲乡人民政府先行提出意见，经县规划设计院复核，报县政府同意后实施。 　　（3）安置面积每套总用地面积不得超过120平方米，建筑总占地面积不得超过90平方米，建筑面积不得超过270平方米，建筑层数不得超过3层，建筑总层高不得超过12.4米（首层高度不得超过3.6米，第二、三层不得超过3.3米，坡屋顶高度不得超过2.2米），具体安置占地面积由南桥镇、菖蒲乡、留车镇人民政府结合实际情况确认。 　　（4）安置房屋由南桥镇、留车镇、菖蒲乡人民政府统一规划、统一设计、统一户型、统一立面，严格按照《寻乌县人民政府办公室关于印发寻乌县村镇规划建设管理暂行办法的通知》（寻府办发〔2017〕3号）、《寻乌县人民政府关于印发寻乌县城市规划区外农村建房审批管理办法的通知》（寻府发〔2020〕10号）相关规定建房，违反规定建房的，一律不予办理相关证件，并依法予以拆除。 　　4．安置办法 　　拆迁农村居民合法住宅房屋，被征收人选择宅基地安置的，按下列规定予以安置： 　　（1）被征收居住主屋占地面积小于安置宅基地面积，差额部分宅基地按800元/平方米标准由被拆迁户缴交。 　　（2）被征收居住主屋占地面积大于安置宅基地面积的，超出部分征收部门按《寻乌县人民政府关于公布实施全县征地区片综合地价的通知》（寻府字〔2020〕37号）宅基地征收补偿标准的3倍给予被征收人征地补偿。 　　（3）2户以上的被征收人共同居住于1栋整体房屋内的，已划分产权并在房屋主管部门登记发证的，按登记的面积认定安置面积，没有在房屋主管部门登记发证的，能够协商的以被征收人协商比例为准，不能协商的按户平均分割面积认定安置面积。 　　5．安置顺序 　　实行“先签约、先弃房，先安置”的原则，即签订补偿协议的顺序号加弃房的顺序号除以2进行排序选宅基地；除以2后仍然相同的，以弃房的顺序号先后选择宅基地。 　　（二）房屋安置 　　被征收人选择房屋安置的，按合法住宅房屋的建筑面积“拆一补一”的原则进行房屋安置。被征收人应当按被征收房屋与提供用于安置房面积“最接近值”的原则选择安置房。因户型面积差异的，超出应安置面积的，按照评估机构评估确定交房时市场价结算。 　　被征收人选择房屋安置的，应安置面积内按照安置房的实际建筑安装成本价（以第三方评估为准，包括设计、建设、监理等各类费用）结算。被征收人应将获得的补偿、补助（除临时过渡安置补助）等费用预先抵扣安置房购置款，不足部分在安置房交付前根据结算据实补足。 　　安置房屋为期房，交房期限为自搬迁期限结束之日起不超过36个月。安置房具体位置由南桥镇、菖蒲乡、留车镇人民政府根据实际情况选址规划，经县规划设计院复核，报县政府同意后确定。 　　安置房建设用地为集体建设用地。安置房的交房标准：符合国家住宅建设有关标准，进户为普通防盗门（高层为防火门），室外门窗为铝合金或塑钢，水、电到户。 　　实行“谁先签订协议、谁先弃房，谁先选房”的原则，即签订补偿协议的顺序号加弃房的顺序号除以2进行排序选房，除以2后仍然相同的，以弃房的顺序号先后选房。 　　（三）货币安置 　　被征收人自愿选择货币安置的，或者被征收人不符合选择宅基地安置条件，且不选择房屋安置的，实行货币安置。被拆迁合法房屋所占宅基地面积按《寻乌县人民政府关于公布实施全县征地区片综合地价的通知》（寻府字〔2020〕37号）中宅基地征收补偿标准的3倍给予货币补偿，被拆迁合法房屋按房屋重置价格给予补偿（详见附件3）。<section data-tools="135编辑器" data-id="29514"><section style='margin-top: 0.5em; display: inline-block; float: left; line-height: 1.6em; margin-right: 5px; margin-left: 5px; max-width: 100%; padding-right: 10px; padding-left: 2em; vertical-align: top; font-family: inherit;'>保障与监督</section></section></section> 　　（一）发布征收土地公告后，被征收人无正当理由不得拒绝领取征地拆迁补偿费用；无正当理由拒绝领取的，可以将征地拆迁补偿费用转入其银行账户，并书面告知被征收人，视为补偿到位。 　　（二）发布征收土地公告后，被征收人拒不签订补偿安置协议或者拒不腾地搬迁的，补偿安置到位后，由县自然资源局作出《责令限期交出土地决定》，被征收人在决定规定期限内仍不腾地搬迁的，依法强制腾地搬迁。 　　（三）在征地拆迁过程中，被征收人伪造、涂改权属证明文件，谎报、瞒报有关数据，冒领、多领、骗取补偿的，依法追回相应补偿；构成犯罪的，依法追究刑事责任。 　　（四）阻扰和破坏征地拆迁工作，妨碍征地拆迁工作人员依法执行公务的，公安机关依法予以罚款、治安拘留；构成犯罪的，依法追究刑事责任。 　　（五）测绘机构、评估机构及其工作人员未履行法定职责，违反相应技术规范或本方案规定的，造成国家损失的，应当承担相应民事责任；构成犯罪的，依法追究刑事责任。 　　（六）实行“四公开”制度：1．征收补偿方案公开；2．房屋产权面积公开；3．调查认定结果公开；4．补偿安置结果公开。 　　（七）党员干部和国家公职人员要带头模范执行土地房屋征收政策，全力支持、配合、服务征收工作，推动项目顺利实施。土地房屋征收涉及的党员干部和国家公职人员所在单位的党政主要负责同志，要负责做好他们的思想工作，教育他们自觉执行土地房屋征收有关规定。纪检监察机关和组织人事部门要充分发挥职能作用，加强对各级各部门及党员干部和国家公职人员在征收工作中执行有关法规、政策、纪律情况的监督检查。对在土地房屋征收中违反有关规定，损害国家、集体和群众利益，造成不良影响的，视情节轻重给予组织处理和纪律处分。 　　（八）纪委监委设立信访举报电话（举报电话为：12388），对土地房屋征收过程中的举报信息进行调查、核实、查处。 　　（九）审计机关应当加强对征收补偿费用管理和使用情况的监督，并公布审计结果。 <section data-tools="135编辑器" data-id="29514"><section style='margin-top: 0.5em;
